I have an 03 Mack CV713 Granite with Chalmers rear suspension, with no Capacity door tag.  I got the build sheet from Mack listing a 14k front axle and 38k rears. I was told that I have a 46k suspension by the Mack parts dealer and I have bought 46k suspension parts.

So... Am I 38k capacity or 46k capacity?

the capacity in reality is up to the operator. if you are buying 46k parts and are the driver . haul under the common sense rule. look back at pictures of old AC Macks  single axles hauling 100K loads. Paperwork wise in to days world !!! that's another story.

34K on a tandem is country wide legal, but each state can set limits in that state over that, and of course if you do heavy haul there is permitting for much higher weights. Also off road use. 

38-40K is std rating now a days on anything for drives, dumpers often go 46K or higher. I'm sure you know, but higher cap housing use thicker wall and bigger bearings, so are an advantage regardless of weight carried in the long run.

 

I don't think many trucks these days run anywhere near legal load limits in Australia 

Gone are the days of people running 50% or more over loaded 

44's are pretty much the standard down here, has been that way for 40 years or more

You are always rated at lowest rating of the axle housing GAWR, Suspension and tire rating. In this case you are good upto 38k lbs GAWR (assuming your tires are rated to 38k lbs too - which should not be a problem IMO). This a 11mm axle housing and cannot be loaded to 46k lbs.
