MarketWatch / May 28, 2025 In a ruling late Wednesday, the 3-member New York-based Court of International Trade blocked Trump’s tariffs dating back to Feb. 1 — including the ”liberation day” tariffs announced April 2 against almost all of America’s trading partners, most of which have been paused — saying they are unconstitutional because the president does not have unlimited authority to impose tariffs. Congress typically must approve tariffs, but the Trump administration claimed that under the International Emergency Economic Powers Act of 1977, the president could impose the tariffs due to a national emergency, citing trade deficits. The U.S. has run trade deficits for nearly 50 years, and the court said they did not constitute an extraordinary threat. While the law allows the president to “regulate…importation,” “those words do not confer unlimited tariff authority,” the court said. “An unlimited delegation of tariff authority would constitute an improper abdication of legislative power to another branch of government,” the court wrote. The court added that in a 1974 trade act, Congress set “specific limits on the president’s authority to respond to balance-of-payments problems,” and that under that act, “even ‘large and serious United States balance-of-payments deficits’ do not necessitate the use of emergency powers.” The ruling pulls the rug out from one of the Trump administration’s signature policies, and it was unclear how it would affect ongoing talks with U.S. trade partners, including the European Union, or recent trade agreements with China and the U.K. The ruling came in response to two lawsuits, one from a group of small businesses that specifically challenged the “liberation day” tariffs and the other by a group of attorneys general from Democratic states that targeted the entire slate of tariffs. The White House quickly appealed the ruling Wednesday night, with spokesperson Kush Desai saying “it is not for unelected judges to decide how to properly address a national emergency,” adding that the administration is “committed to using every lever of executive power to address this crisis and restore American Greatness.” https://www.cit.uscourts.gov/

  7. President Trump threatened Apple with a tariff of at least 25% if it does not manufacture iPhones in the US, ramping up pressure on the tech giant to secure more domestic production. I have long ago informed Tim Cook of Apple that I expect their iPhone’s that will be sold in the United States of America will be manufactured and built in the United States, not India, or anyplace else.. If that is not the case, a Tariff of at least 25% must be paid by Apple to the US.
  8. The European Union, which was formed for the primary purpose of taking advantage of the United States on trade, has been very difficult to deal with. Their powerful trade barriers, VAT taxes, ridiculous corporate penalties, non-monetary trade barriers, monetary manipulations, unfair and unjustified lawsuits against Americans companies, and more, have led to a trade deficit with the U.S. of more than $250 million a year, a number which is totally unacceptable. Our discussions with them are going nowhere! Therefore, I am recommending a straight 50% tariff on the European Union, starting on June 1, 2025.   12. The 4.17 harkens back to a tractor with a 237 and 5-speed. With a 300/5-speed, then a 3.87. The 4.42 was my go-to for a 10-speed T2100, at the bottom of the fuel curve at speed.

Ukraine’s Defense Intelligence Directorate has released video footage showing a dramatic battlefield recovery of a disabled Navistar International M1224 MaxxPro MRAP armored vehicle during an operation near Kupiansk. The vehicle was hit by Russian fire while transporting personnel from the Timur special operations unit. Despite the strike, the MaxxPro’s armored capsule shielded the troops, allowing them to dismount and continue their mission on foot. The vehicle remained stranded in a hostile zone under threat of further attacks. Rather than abandon the vehicle, determining the engine was still functional, the driver re-entered the damaged MaxxPro and drove it out of the battle area despite one missing wheel. .
  15. After all the fuss and expenditure of US taxpayer dollars, the principle recipient of the JLTV is backing out of the program (the always under-funded Marines will still buy it). The Army will buy GM's Chevrolet Colorado/Canyon-based Infantry Squad Vehicle. The two vehicles are quite different. If I was concerned about IEDs buried in roads, e.g. Afghanistan, I'd rather be in the JLTV.
