if seller has a title and they say its clean they are referring that the title has no liens against said vehicle and can be transferred to the buyer. if a lien is present on title the seller has to provide a lien release(signed). if not, the titling agent will not transfer the title into the buyers name. if no title is present, the seller should for legal purposes provide a bill of sale(should be notorized). then the buyer can proceed to obtain a title(lost title) with the bill of sale. the local agent then will conduct a search for a current title and whose name appears on said title. then the buyer has to settle with the person whose name appears on the title(could be the seller or someone else). even with a bill of sale does not mean that the purchase is rightfully theirs until a search is complete to find the rightful owner. contact your local agent that handles titles and tags.
